Last updated: September 23, 2026. These Terms of Use (“Terms”) form an agreement between you and Catch (“Catch,” “we,” “us,” or “our”) governing the Catch websites, accounts, listings, auctions, communications, and related services (collectively, the “Services”).
1. Acceptance and eligibility
You must be at least 18 years old, have legal capacity to enter a binding contract, and use the Services only where lawful. If you act for a business or another person, you represent that you have authority to bind them. Additional written rules shown for a particular auction, payment, financing option, shipment, promotion, or feature become part of these Terms for that activity.
2. Catch’s role
Catch provides an online marketplace that helps vehicle owners present vehicles and potential buyers discover and bid on them. Unless a listing expressly says otherwise, Catch is not the seller, buyer, owner, dealer, broker, carrier, lender, insurer, escrow agent, or repair facility for a listed vehicle. Catch does not take title to or possession of a vehicle merely because it appears on the Services.
Buyers and sellers are responsible for the vehicle transaction between them, including their final purchase documents, payment, title transfer, registration, taxes, pickup, delivery, insurance, and compliance with applicable law. Catch may support listing preparation and transaction coordination without becoming a party to the vehicle sale.
3. Accounts, identity, and communications
- Provide complete, truthful, current information and promptly update it.
- Protect your password and account; activity through your account is treated as authorized unless you promptly report misuse.
- Complete identity, payment-method, funds, title, ownership, or other verification we reasonably request.
- Do not create accounts to evade a restriction or use another person’s identity or payment method without authorization.
- You consent to receive transaction notices electronically. Marketing communications remain subject to applicable consent and opt-out rules.
We may reject, restrict, suspend, or close an account when reasonably necessary to protect users, investigate suspected fraud, enforce these Terms, comply with law, or protect the Services.
4. Vehicle listings and information
Vehicle descriptions, title status, mileage, condition, history, photographs, documents, ownership statements, and disclosures are supplied primarily by sellers or third parties. Catch may edit or organize that material for clarity, but the seller remains responsible for its accuracy and completeness.
Catch may review submissions, request additional records, correct obvious errors, postpone publication, refuse a vehicle, or remove a listing. Acceptance of a submission is not an appraisal, inspection, certification, warranty, or endorsement. Buyers must independently verify all facts material to their decision, including identity, ownership, liens, title status, VIN, mileage, condition, authenticity, modifications, recalls, import status, emissions compliance, and eligibility for registration.
5. Auction rules
Bids
A live bid is an offer to purchase the listed vehicle at the bid amount, subject to the auction’s stated terms. Bids are binding and may not be withdrawn except when Catch expressly permits it because of a material listing change or clear technical error. Do not bid unless you are ready and able to complete the purchase.
Reserve and no-reserve auctions
A reserve is the confidential minimum price a seller will accept. If the reserve is met when the auction closes, the highest bidder is the winning bidder. In a no-reserve auction, the highest valid bidder wins regardless of price. If a reserve is not met, there is no winning sale. Catch may facilitate a separate discussion, but neither party is committed unless they reach a new agreement. Sellers may request a lower reserve during a live auction; a reserve may not be raised after bidding begins.
Closing, extensions, and corrections
Catch’s planned standard auction runs for seven days. An accepted bid within the final two minutes resets the remaining time to two minutes; this repeats until two minutes pass without another accepted bid. Any auction-specific variation must be shown before bidding. These mechanics are currently demonstrated only; there are no live auctions. Catch may invalidate fraudulent, mistaken, duplicative, manipulated, or technically compromised bids; correct platform errors; extend, pause, cancel, or rerun an auction; and determine the winning bid using reasonably available records. Catch’s good-faith marketplace decision is final to the extent permitted by law.
Post-auction completion
After a winning bid, Catch may share the buyer’s and seller’s contact information and provide a completion checklist. Buyer and seller must promptly communicate and complete the transaction within the timeframe shown for the auction. An auction result does not guarantee that either party will perform.
6. Buyer responsibilities
Before bidding, each buyer must review the complete listing, ask questions, arrange any desired inspection, research taxes and registration, understand transport costs, and secure sufficient funds. Vehicles are typically used, may contain defects, and may not satisfy the buyer’s intended use or home-jurisdiction requirements.
The winning buyer must pay all amounts when due, complete required documents, maintain insurance when appropriate, and arrange timely pickup or transport. A buyer who fails to complete a valid winning purchase may lose fees or deposits, be responsible for reasonable costs or losses caused by the failure, and have bidding privileges restricted.
7. Seller responsibilities
A seller represents that they have authority to sell the vehicle and will disclose all material facts, including ownership, liens, title brands, damage, known mechanical defects, mileage discrepancies, modifications, and any pending sale or dispute. The seller must keep the vehicle in substantially the represented condition, make it available for agreed inspection or pickup, deliver marketable title as promised, and complete a valid sale when the reserve is met or the auction is no reserve.
Once Catch publishes a vehicle, the seller may not sell it elsewhere or materially alter, dismantle, encumber, or withdraw it during the auction without Catch’s written approval. A seller who circumvents the auction, misstates material facts, or refuses to complete a valid sale may owe applicable fees and reasonable costs and may lose access to Catch.
8. Fees, deposits, payments, taxes, and refunds
The pricing page sets out planned seller pricing: Catch Listing at $99, Catch Ready at $449, and Catch Select by quote. Standard Listing has no seller commission. Catch’s buyer fee is not yet set. No live bidding or fee collection will open until the applicable fees and any authorization-hold terms are disclosed before commitment. The preview processes no payments or holds.
Fees, deposits, authorization holds, and payment timing will be disclosed before you incur them. You authorize Catch and its payment providers to charge the payment method you submit for amounts you approve or owe under these Terms. You are responsible for applicable taxes, registration, title, inspection, shipping, currency-conversion, and governmental charges unless the listing expressly states otherwise.
Catch fees compensate Catch for marketplace services and are separate from the vehicle purchase price. Unless required by law or stated otherwise at checkout, marketplace fees are nonrefundable after the associated service is performed. Refunds or remedies concerning the vehicle itself are matters between buyer and seller.
9. Financing, payment, transport, and third-party services
Catch may introduce users to independent lenders, payment processors, inspectors, history-report providers, insurers, storage facilities, or transport companies. Those providers control their own eligibility decisions, pricing, contracts, schedules, and performance. Catch does not guarantee financing approval, payment settlement, pickup or delivery time, carrier performance, insurance coverage, or a third party’s goods or services. Third-party terms and privacy practices apply directly to you.
10. User content and intellectual property
You retain ownership of photographs, descriptions, comments, messages, and other material you submit (“User Content”). You grant Catch a worldwide, nonexclusive, royalty-free, sublicensable license to host, reproduce, edit, format, publish, distribute, promote, archive, and display that User Content for operating, improving, and marketing the Services and completed listings. You represent that you have the rights needed to grant this license and that your content is accurate, lawful, and noninfringing.
Catch’s name, marks, interface, software, editorial content, and marketplace compilation belong to Catch or its licensors. You may use the Services only for personal or internal business purposes connected with legitimate marketplace activity. You may not scrape, copy, frame, republish, sell, reverse engineer, or commercially exploit them without written permission, except as applicable law permits.
11. Prohibited conduct
Vehicle discussions should be relevant, respectful, and factual. Identify opinion or uncertainty, avoid publishing personal contact details or private documents, and do not use comments to solicit unrelated business. Sellers should answer material vehicle questions and disclose new information to all bidders. Sample questions in the preview are not sent or published.
You may not manipulate bidding, bid on your own vehicle, coordinate sham bids, interfere with another user’s transaction, evade fees, move an introduced transaction off-platform to avoid fees, submit false information, traffic in stolen or unlawfully imported vehicles, infringe rights, harass users, send spam, introduce malicious code, probe security, automate access without permission, launder funds, abuse payment systems, or violate trade, sanctions, anti-money-laundering, consumer-protection, privacy, or motor-vehicle laws.
12. Assumption of risk; disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CATCH DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
Catch does not guarantee that listings are accurate, vehicles are authentic or defect-free, title is valid or transferable, users will perform, third parties will act properly, or the Services will be uninterrupted or error-free. Your decision to inspect, bid on, purchase, sell, ship, finance, or use a vehicle is at your own risk. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
13. Release, indemnity, and limitation of liability
To the extent permitted by law, you release Catch and its affiliates, personnel, and service providers from claims arising from disputes between you and another user or third party. You agree to defend and indemnify them against third-party claims, losses, and reasonable legal expenses caused by your User Content, your breach of these Terms, your violation of law, or your misuse of the Services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATCH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, DATA, USE, OR OPPORTUNITY; VEHICLE DAMAGE OR DIMINUTION; OR LOSSES CAUSED BY ANOTHER USER OR THIRD PARTY. CATCH’S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE FEES YOU PAID DIRECTLY TO CATCH DURING THE 12 MONTHS BEFORE THE CLAIM.
14. Disputes, governing law, and venue
Before filing a claim against Catch, you and Catch will first send a written notice describing the facts, requested relief, and relevant account or auction, then make a good-faith effort to resolve the dispute for 30 days. This requirement does not prevent either party from seeking urgent injunctive relief or filing an eligible small-claims matter.
These Terms and disputes with Catch are governed by Colorado law, without regard to conflict-of-law rules. Unless the parties later adopt a separately reviewed arbitration agreement, any court proceeding against Catch must be brought exclusively in the state or federal courts located in Denver, Colorado, and each party consents to those courts. Claims between buyers and sellers remain their responsibility and may be governed by their separate agreement and applicable law.
15. Changes, termination, and general terms
We may change the Services or these Terms prospectively. Material changes will be posted with a new effective date and, when appropriate, communicated through the Services. Continued use after the effective date constitutes acceptance. We may discontinue features or terminate access, but provisions that by nature should survive—including payment obligations, licenses, disclaimers, liability limits, and dispute terms—will survive.
These Terms, the Privacy Notice, auction-specific disclosures, and any terms presented at checkout are the entire agreement between you and Catch about the Services. If one provision is unenforceable, it will be modified only as needed and the rest will remain effective. A delay in enforcement is not a waiver. You may not transfer your account or these Terms without consent; Catch may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
